Who can donate 1.5% of their tax?

Individuals who settle their income tax in Poland are entitled to donate 1.5% of their tax to public benefit organizations (OPP). If you settle your tax with the Tax Office:

  • flat rate on recorded income,
  • on general terms,
  • flat tax,

you can decide in your PIT form where to allocate 1.5% of your tax due.

Regardless of whether you are employed under an employment contract, a contract for specific work, or a contract of mandate, are a pensioner, run a sole proprietorship, or are a farmer with income taxed under PIT, you have the right to donate 1.5% of your tax, provided that your annual tax return shows tax due. What does this mean?

If, according to your PIT, you do not have to pay tax or you have no income at all and do not submit a PIT return, you cannot donate 1.5% of your tax. This form of support for public benefit organizations is also not available to legal entities and taxpayers who do not submit their PIT returns on time. Furthermore, in order to donate 1.5%, you must pay the tax due within 2 months of the deadline for filing tax returns. This is usually April 30 of the year following the tax year.

What percentage of tax can be donated to foundations?

From 2023, taxpayers will be able to donate not 1% but 1.5% of their personal income tax to public benefit organizations. The increased tax rate is good news for all public benefit organizations, enabling them to raise more funds to achieve their statutory objectives.

How to transfer tax?

The Tax Office will do it for you. The process of transferring 1.5% is automatic and does not involve any fees. You only need to remember one thing—to indicate the KRS number of the organization you want to donate part of your tax to, and possibly the specific purpose, on the PIT form. How to donate 1.5% – instructions for completing the form

You can complete your annual tax return in two ways – traditionally on paper or online using the Twój e-PIT service.

In the first case, you must fill out the form yourself, in the second case, the US will do it for you – all you have to do is approve it (if you do not, the US will automatically approve it on April 30, but you will lose the opportunity to enter the KRS OPP number in the declaration and transfer 1.5%).

Regardless of the type of PIT form you are filling out, each form contains a section related to who to transfer 1.5% of your tax to, or more specifically, "APPLICATION FOR THE TRANSFER OF 1% OF TAX DUE TO A PUBLIC BENEFIT ORGANIZATION (OPP). Fill it in by entering the KRS number of the organization you have chosen. If you know exactly who to transfer the tax to, you can fill in another section by entering the SPECIFIC PURPOSE, for example, the name and surname of the person in need. Also, indicate whether you agree to provide the organization with your data, i.e., your name, surname, address, and the amount transferred. If you do not give your consent, your 1.5% tax will be transferred anonymously.

The aforementioned 1.5% tax due is the maximum amount you can transfer. It can be lower if you wish.

How do I donate 1.5% if I file more than one tax return?

If you file more than one tax return, you can indicate on each form who should receive 1.5% of your tax due. It does not have to be the same public benefit organization on all returns; you can specify a different organization on each one.

How do I transfer my tax if I am a pensioner or disability pensioner?

If you are a pensioner or disability pensioner and your pension authority provides you with a PIT-40A form, you can indicate where to transfer 1.5% of your tax in the PIT-OP form. This is a short statement in which you only provide the KRS number of the selected organization and your details. You can submit it online or in the traditional way.

Is it sufficient for me to indicate who to transfer the tax to only once?

If you provided the KRS OPP number in your previous tax return or have already submitted a PIT-OP form, you do not need to choose again who to donate 1.5% of your tax to. The tax office will automatically transfer it to the organization you previously indicated.

How to change the organization to which you donate 1.5% of your tax?

Using the Twój e-PIT service, you can edit the form prepared in advance by the tax office and change the organization to which you will donate your 1.5% tax. If you have submitted a PIT-OP form, you must submit it again, revoking your consent to transfer 1.5% of your tax to the previously indicated organization and selecting a new one.

Can I indicate the KRS number in my tax return correction?

If you have not previously indicated in your tax return where to transfer 1.5% of your tax, or if you want to change the organization you previously indicated, you can do so by amending your tax return. Condition: the amendment must be submitted within one month of the deadline for filing returns.
